ICP is often used as shorthand for several different Chinese internet registrations. That causes costly mistakes: a footer filing number is not a commercial ICP licence, domain real-name verification is not website filing, and mobile-app filing is not automatically completed by filing a marketing site. The MIIT filing system is the official public record and filing-number destination. This guide is for foreign teams choosing a China hosting and operating model.

What you need to know

  • Non-commercial website ICP filing is 互联网信息服务备案, usually called ICP备案.
  • A commercial ICP licence (ICP许可证) is a separate permission for qualifying commercial internet information services.
  • Public-security filing (公安备案), domain real-name verification and APP备案 are separate processes.
  • Hosting a public site on mainland China infrastructure normally triggers the filing path; Hong Kong is outside the mainland filing system.
  • A foreign company without a mainland legal presence commonly cannot complete ordinary entity filing directly. A foreign-invested Chinese subsidiary may be able to file, subject to its business scope and the service.
  • Provider and provincial procedures vary. Confirm against the current communications administration and hosting provider.

MIIT's app-filing explanation says apps and websites both provide internet information services and use a related filing architecture. If an operator already has website filing, it may supplement app information rather than repeat all subject identity data. That operational reuse does not make the service records identical.

Who needs website ICP filing?

If a domain resolves to and serves a public website from mainland China infrastructure, the access provider normally requires filing before opening the service. Chinese cloud documentation enforces “who provides access handles filing.” A site on a Hong Kong, Singapore or other overseas server generally cannot use that server to obtain mainland filing and normally does not need filing solely because Chinese users visit it.

Hosting location is not the only regulatory question. Content category, commercial model, operator and audience can create other requirements even when hosted abroad.

Foreign individuals and companies

Eligibility differs from simply owning a domain. Foreign individuals should check province-specific identity, residence and contact requirements. A company incorporated only overseas commonly lacks the mainland entity documents used for enterprise filing. A Chinese subsidiary—including an eligible foreign-invested enterprise—can be the operator when that reflects reality and its corporate/business scope permits the service.

A representative office is not a separate Chinese legal person and should not be assumed sufficient. Ask the provider and the relevant provincial administration before designing around it.

Using a local partner merely as a nominee is risky. The public filing names that partner as operator; the provider account, domain, content responsibility and app filing may become coupled to it. If a genuine partner operates the service, contracts should cover domains, data, content moderation, security, filings, incident response, transfer and termination.

Domain and cloud prerequisites

The domain should be registered through an eligible registrar and complete real-name verification. Registrant identity generally needs to match or be appropriately connected to the filing entity. Tencent's 2026 guidance says a domain registered outside China cannot be filed directly until transferred to a qualified mainland registrar; confirm the current provider rule for your TLD.

Purchase an eligible mainland resource from the access provider through which you will file. Exact product term, public-IP and subscription requirements are provider-specific and change, with Tencent, Alibaba and Huawei each applying their own conditions.

Prepare:

  • Chinese entity business licence or accepted personal identity documents;
  • responsible-person and service-responsible-person information;
  • mainland contact methods required by the process;
  • domain certificate and real-name information;
  • eligible hosting/access-service proof;
  • website/app name, purpose, language and content description;
  • face/identity verification and authorisations;
  • pre-approval documents for regulated sectors.

Provincial differences

The provincial communications administration reviews the filing based on the operator's location. Naming, responsible-person, document and site-content expectations can differ. The statutory framework provides an outside review period when materials are complete, but provider pre-check, corrections and verification add time. Step-by-step website filing

  1. Decide the actual operator and whether service is non-commercial or potentially licensed.
  2. Select mainland infrastructure and an access provider that supports filing for that operator.
  3. Align domain registrant, cloud account and operator records.
  4. Identify sector pre-approvals before submitting.
  5. Submit subject and website/service information through the provider.
  6. Complete responsible-person, face and SMS verification as requested.
  7. Respond to provider pre-check corrections.
  8. The provider forwards the complete application to the provincial administration.
  9. After approval, display the ICP filing number in the website footer and link it as required.
  10. Complete applicable public-security filing after launch and keep records updated.

The public-security rules state that applicable organisations using international networks should file within 30 days of formal connection. Current provider documentation also directs filed services to the public-security process after opening. Confirm the local portal and scope.

APP filing and APIs

MIIT's notice says app operators conducting internet information services in China must file and distribution platforms must not distribute unfiled apps. The operator submits through its network access provider or distribution platform. The filing covers app identity, domains, IPs and service information; the number must be displayed prominently and linked to MIIT's filing system.

An API or backend has no universal exemption merely because it lacks a homepage. Assess what hostname and mainland resources provide the app's internet service. A backend hosted outside mainland China does not automatically create website ICP filing, but APP filing, app-store rules, data, sector and cross-border obligations may still apply.

WeChat Mini Programs

MIIT's notice expressly includes Mini Programs and similar distribution in the app-filing ecosystem. WeChat account verification, service category, Mini Program filing, payments and sector licences remain separate platform/regulatory tasks. A Mini Program is not an ICP workaround.

Changing providers and migration

A filing is associated with the operator, service and access provider. When moving to a new mainland provider, complete access filing before cutting traffic. Tencent's current guidance allows multiple access providers concurrently, which helps migration. Keeping the old relationship in place until the new access filing is complete reduces the risk of losing the existing access record.

A filing is not freely “transferred” between unrelated legal entities. Entity changes can require a change, cancellation and new filing depending on the facts and province.

  • Foreign company lacks acceptable mainland filing identity.
  • Website name implies a regulated or governmental role.
  • Sector pre-approval is missing.
  • Responsible-person contact or face verification fails.

  • Domain/TLD or server product is not eligible.
  • The application calls a commercial service non-commercial without analysis.
  • Province-specific materials are incomplete.

  2. Do you have an eligible mainland operator? If no, form one, appoint a genuine operator, or stay offshore.
  3. Is the service non-commercial? If uncertain, obtain a licence/business-scope assessment.
  4. Is the category regulated? Secure pre-approval before filing.

Frequently asked questions

Can a foreign company get ICP filing directly?

An overseas entity commonly cannot use the ordinary mainland-company path. An eligible mainland subsidiary can often file for a service it genuinely operates. Confirm with the provider and province.

Does Hong Kong hosting require ICP filing?

Hong Kong servers are not mainland servers and cannot be used to obtain mainland hosting filing. Other Chinese laws and platform rules can still matter.

Is ICP filing free?

Providers often state the filing service is free, but eligible hosting, domains, verification, corporate setup and professional help cost money.

Does an app hosted overseas need APP filing?

Hosting location alone is not the full APP备案 test. MIIT frames the rule around providing app internet information services in China. Confirm the current filing route for your operator and distribution plan.

Start with architecture and operator reality. If mainland hosting is necessary and an eligible entity genuinely operates the service, align domain, provider and category documents, then file. Otherwise, choose an offshore architecture consciously instead of using a nominee to force a filing.
