Do You Need Software Copyright Registration for a Chinese App?

A 2026 guide to Chinese Software Copyright Registration, Android store evidence, foreign ownership, source-code documents, agents, risks, and updates.

Do You Need Software Copyright Registration for a Chinese App?

Computer Software Copyright Registration (计算机软件著作权登记, often shortened to 软著) is frequently one of the first unfamiliar documents a foreign Android developer encounters in China. The answer to “do we need it?” depends on whether you mean copyright law, an app-store rule, evidence in a dispute, or a commercial partner's onboarding policy.

What you need to know

  • Copyright and registration are not the same: a software work can be protected without voluntary registration, subject to applicable law and facts.
  • Mainland Android stores commonly request a registration certificate or an accepted alternative before listing or updating an app.
  • Apple does not impose Software Copyright Registration as a universal App Store submission document.
  • The certificate is evidence of a registered work and claimant; it does not prove every line is original, grant a business licence, complete APP filing or resolve third-party rights.
  • Foreign claimants can face document, translation and agency logistics. A partner can assist without receiving ownership of the work.

What the certificate proves—and does not

The China Copyright Protection Center registration system records information submitted about a software work and issues a certificate after the applicable review. The certificate can be useful evidence of the software name, version, completion/publication information and registered claimant.

It does not automatically prove that the claimant owns every dependency, that no earlier work exists, that employee/contractor assignments are valid, or that the app complies with privacy, content and licensing rules. It is separate from APP filing and ICP filing.

Is it legally mandatory for every app?

Registration is not a universal legal prerequisite for software copyright. The practical pressure often comes from private store policy. Xiaomi's published policy, for example, asks for a Computer Software Copyright Registration Certificate or accepted electronic-copyright evidence. Huawei flags software copyright among possible app-qualification evidence. Other stores' category and evidence rules change.

Distribution route Typical relevance
Mainland Android stores Commonly requested; check each current qualification matrix
Apple App Store Not a universal Apple submission requirement; China filing/licences may still apply
Website Not ordinarily a hosting/ICP prerequisite
WeChat Mini Program Not a universal substitute for account, category or filing requirements
Enterprise/private deployment May not be a store gate, but customers can request rights evidence

Foreign companies and ownership

The copyright owner does not have to become a Chinese company merely because the app will be used in China. Foreign applicants may, however, need authenticated corporate evidence, Chinese translations and a local agent or representative for the process. Confirm the current accepted documents with the official registration system or a qualified agent.

A Chinese subsidiary can own or license the software. A publisher can also receive limited distribution rights while the foreign parent remains owner. The dangerous shortcut is registering the core work in a distributor's name without a deliberate assignment. That can impair control over store accounts, enforcement, financing, future publishers and exit.

Your agreement should state:

  • ownership of pre-existing and new code;
  • territory, platforms, duration and sublicensing rights;
  • who may register and in whose name;
  • package/signing and source-code custody;
  • obligation to assist with changes or cancellation;
  • treatment of improvements after termination.

Prepare the chain of title

Before applying, audit who created the software. Employee work should be covered by employment terms and applicable rules. Contractor work needs a written assignment or licence with sufficient scope. Record corporate reorganisations and prior product-name changes.

For open-source and third-party code, keep a software bill of materials and licences. Registration does not convert those components into your exclusive property. Remove secrets, API keys, credentials, signing material, personal data and proprietary production configuration from any submitted source excerpt.

Application materials

The current application commonly calls for claimant identity documents, an application form, identifying software information, source-code documentation and a user/design manual. Chinese-language presentation or translation may be needed. Exact page, line and formatting requirements are administrative details that can change; use the official portal's current template instead of relying on a fixed number quoted by an agent's old blog post.

Source documentation should be representative and consistent with the named version. A manual can explain purpose, architecture, screens and operation. The software name and version should match the store listing or have an explainable relationship.

Step-by-step process

  1. Decide the correct owner and registered software version.
  2. Audit employee, contractor, open-source and third-party rights.
  3. Choose direct filing or an agent; verify the government channel and agent authority.
  4. Prepare corporate/identity documents and Chinese translations as required.
  5. Produce clean source excerpts without secrets and a matching manual.
  6. Submit through the current China Copyright Protection Center process.
  7. Answer correction requests consistently and keep the underlying authorship facts unchanged.
  8. Verify certificate names, version and claimant after issuance.
  9. Store the application set and use accepted copies in store submissions.
  10. Assess whether a materially different product or ownership change needs a new or changed record.

Government and agent-assisted filing are not different kinds of copyright. An agent manages paperwork; it should not become claimant unless that reflects a real, intended ownership transaction.

Timing and cost

There is no universal processing time. Completeness, correction requests, channel and available processing options all affect timing. Official charges and agent fees are different: an agent may charge for translation, document preparation or expedited handling even where a government service has no comparable fee. A useful quote separates the government component from the agent's services.

Alternatives and exceptions

Some stores may accept an electronic copyright certificate, prior-store ownership proof, signing/package ownership, a licence or another platform-specific document in defined situations. Acceptance is not uniform. Ask the store which document type and relationship evidence it accepts for the exact category and submission (new app, update, transfer or package claim).

Common delays or rejection causes

  • Claimant name differs from corporate evidence.
  • Software name/version does not match the source, manual or listing.
  • Source formatting is incomplete or contains unexplained gaps.
  • Corporate authorisation or foreign documents are not accepted in their submitted form.
  • Ownership from contractors or a former company is unclear.
  • The application asserts ownership of third-party/open-source material too broadly.
  • A store receives a valid certificate but no licence connecting claimant and developer.

Practical recommendation

Situation Recommendation
Long-term multi-store mainland Android launch Begin registration early under the intended owner
One-store pilot Ask that store about accepted alternatives before transferring IP
Foreign parent owns core platform Keep ownership with the parent unless a real assignment is intended; license the China publisher
White-label apps Decide whether the registered work covers the platform or each materially distinct variant
Apple-only launch Focus first on APP filing and category requirements; registration may still have evidence value

Frequently asked questions

It is evidence of registration rather than proof of the complete underlying rights or chain of title.

Must the owner be Chinese?

Not as a universal copyright principle. Foreign applicants should confirm current procedural documents and translation/authentication requirements.

How much source code is submitted?

Use the current official specification. Fixed page/line claims become outdated and can differ by application path.

Do substantial updates need new registration?

Not every update does. Consider a new record when the registered identity, ownership or software has changed materially, and check each store's version-matching policy.

Conclusion

Treat registration as evidence and distribution infrastructure, not a substitute for legal ownership. Establish the chain of title first, register under the intended owner, and give any China publisher only the rights it actually needs.
